Driving without insurance
As a basic minimum, the law requires that all drivers have third party insurance even if the car is parked on a public highway. If you are found to have parked a car on the road or caught driving without insurance, you can expect a fine up to £5,000, 6-8 points on your license and a possible unlimited driving ban. Clearly it is a serious offence with potentially severe legal ramifications.
However, there are defences that can be used including lapsed or cancelled insurance, expired MOT certificates, driving a company vehicle which you reasonably believed to have been insured and a variety of mitigating factors.
Dangerous driving
If you have been charged with dangerous driving, there are a variety of possible defences including duress by another person which caused or forced you to drive dangerously and necessity due to the fault/indiscretion of others.
Speed camera evidence
Speed cameras have to be properly maintained, calibrated and approved for use by the Home Office. GATSO cameras, which are the most common speed camera used in the UK, often cannot take photos of the driver which can be used in a driver’s defence where applicable. Also remember that you are entitled to request any photos taken by speed cameras and such evidence could prove vital in fighting the charge against you.
